j1oi3amq352894The only state in Mexico where surrogacy is legislated is Tabasco. The Civil Code of the State of Tabasco distinguishes specifically surrogacy and the rights for the intended parents.

Tabasco Law | 92nd Article

Established in the 92nd Article of Tabasco's Civil Code: In the case of children born as the result of the participation of a gestational surrogate mother, the contracting parent will presume parenthood when he/she registers the child's birth, since this action implies the acceptance of the parenthood.

Tabasco Law | 347th Article

Established in the 347th Article of Tabasco's Civil Code: When a second woman participates in the reproductive process, the contracting mother will be presumed as the legal mother, whether she provides the egg or not. This is when the gestational surrogate mother is not the biological mother of the child and it is born as a result of an embryo transfer. In this case, the contracting mother should be considered as the legal mother of the child.

It is very important to know that the jurisdiction of Tabasco does not discriminate marital status or sexual orientation. Only the names of intended parents will be indicated in the baby's birth certificate. Our lawyers are always ready to answer any questions about the legal process.
